Under the updated law, that restriction has been removed.
Now, municipalities must actively opt out if they want to prohibit cannabis deliveries. Unless a town submits a waiver to the Massachusetts Cannabis Control Commission (CCC), licensed delivery operators are permitted to serve residents—even if the town doesn’t allow retail dispensaries.

Not every municipality has chosen to participate.
On June 9, the Foxborough Select Board voted to prohibit licensed cannabis deliveries within town limits.
According to reports from the meeting, the decision was made without public comment from Foxborough residents, and there was no input presented from the Foxborough Police Department during the discussion.
As a result, licensed delivery operators are currently unable to deliver cannabis products to addresses within Foxborough.
The situation also illustrates how local policies can differ from one community to another, even as statewide cannabis access continues to expand.
